What would happen if a criminal got amnesia?

Let's say someone as bad as Osama gets into an accident and gets amnesia. Would they still be punished for a crime they can't remember committing? Or would we try to work with them to see if they will change? What would happen if a criminal got amnesia?
Think about the "door of injustice" you would be opening up! Amnesia is almost totally SUBJECTIVE. You would have all sorts of folks doing horrible things and then saying they 'just didn't remember' it.

If the evidence is present, and on the basis of the evidence they are found 'guilty as charged', then it wouldn't matter whether they remember it or not. The victims of the crimes, and the victims families ALL remember the crimes that were committed, and justice should be served...

We NEED to focus MORE on the VICTIMS of crime, even more than the perpetrators. Currently almost NOTHING is done for the families who have suffered at the hands of these mad men (Hitler, Mao, Mussolini, Saddam Hussein, Osama Bin Laden, Stalin, Ernesto "Che" Guevara, Pol Pot, and many others...). Millions have died, sadistically, horribly, at the hands of these evil individuals.

I would not CARE whether or not they 'remember' what they were responsible for or not, the fact is that thousands and millions DO remember. Does the fact that they have managed to block it out of their minds (voluntarily or involuntarily) alter the truth of the evidence? What would happen if a criminal got amnesia?
Yes, they will still be charged. Being unable to remember doing the crime(s) does not excuse the fact that you did do the crime(s).

I could only imagine a DUI driver killing an innocent motorist, then coming to in the hospital with a defense of "I blacked out and don't remember anything... thus, I must be declared innocent."What would happen if a criminal got amnesia?
Can't afford a "miraculous" recovery.

Amnesia is evils most common malady.
